Notes from SOUTHERN LEGACY:
On 7 Feb 1729, Thomas Sr. deeded James a negro woman by the name ofHannah. "Apparently, Hannah was received as 'deed of gift' byElizabeth, step-mother of James, from Dorcas Jordan in 1696. Elizabethrefused to accept that part of the will of Thomas Muse Sr., whichdeeded Hannah to James in 1729."177

in his will, 1729, spoke of himself as "well stricken in years". When his will was offered for probate in 1732, "Elizabeth Muse the relict of the said decedent appeared and in open Court re-fused to accept of and disannulled such part of the said will as any way related to her so far as to debarr her of her dower or thirds of her said deceased husband's estate." Her husband had, in 1729, made a deed of gift to his son by a former marriage James Muse of the negro woman Hannah, who had been given to Elizabeth at date of marriage to her first husband, John Stewart, Sr., by her grandmother, Dorcas (Spence) Jordon, the slave provided for Elizabeth in the will of her step-grandfather, John Jordon. At the same time that James Muse was given the negro woman Hannah, Elizabeth's eldest son by Thomas Muse, Sr., (Nicholas Muse 2nd), was given a negro man by the name of Harry, the property of Thomas, and not of his wife, Elizabeth. Those two slaves were the only property given to James and Nicholas by their father. The will of Elizaheth Muse was first brought into Court by her son, Nicholasa Muse, March 29-1735. It was neither witnessed, dated, or signed. On that day, Christopher Muse, step-son of Elizabeth Muse, made oath "that the within writing was writ by Thomas Muse," (brother of Christopher) "by the request of Elizabeth Muse and that it was her desire her estate should be divided among her children after her death as it is within mentioned . . .
Will of Elizabeth Muse. March 29, 1735: (1) to son William one cow one calf a pot a passeIl . . . and all the corn that I lent him in the year 1733 and the 2 hhds. corn that John Muse owes me one 30 shillings cash and one table. (2) to son Nicholas Muse one cow one yearlin steare one blanket one sheate and seeder pail. (3) to son Daniel one bed one pair of sheats one pare of pillers one pare of blanketts one chist 2 basins 2 dishes fore plates one silk rug. (4) to Dafter Ann Chiton one spice morter and pesell one castin ladle for her natural life and after her death to Letes Chilton. (5) to my Dauter Ann Chilton one washing toob. (6) to my Dafter Elizabeth Barnet one bell mettle skillet during her life and after hare death to Barbary Minor. (7) to my granddafter Mary Minor my saddle and bridle and speening wheel. Westmoreland ss. This day CHRISTOPHER MUSE made Oath before me that the within Writing was writ by THOMAS MUSE by the request of ELIZABETH MUSE and that it was her desire her Estate should be devided among her Children after her death as it is within mentioned and that she was in her perfectt senses, Given under my hand this 29th day of March 1735. Westmoreland ss. At a Court held for the said County the 27th day of May 1735. This Writing purporting to be the Last Will and Testament of ELIZABETH MUSE, deced., was presented into Court by NICHOLAS MUSE and upon the examination of Mary Harvey, Daniel Muse, and Mary Stowers, touching their knowledge of the said Writing (they being sworn thereto) and by the Deposition of CHRISTOPHER MUSE, it is the opinion of this Court that the same is a good Will tho not signed by the Decedant or dated witnesses or any Exr. therein named And thereupon the same is admitted to Record; And upon the mocon of NICHOLAS MUSE, one of the Sons of the said Decedant, he was admitted to make Oath thereto & upon his performing what is usual in such cases & giving EDWARD MUSE for security according to Law, Certificate is granted him for obtaining Letters of Administration thereupon with ye said Will annexed in due form.
